Draft for legal review — not yet in force

Draft. This document was prepared for review by Watzaura's lawyers and has not been adopted. It is published so the structure and intent are visible; the adopted version will replace it here with an effective date.

About these terms

These terms are between you and Watzaura Infotech Pty Limited (ABN 32 702 553 857), an Australian company based in Melbourne, Victoria. They cover two things:

  • your use of this website, watzaura.com, including requesting early access or booking a demo; and
  • your use of Arenzo, our academy platform and its mobile app, as a parent, guardian, athlete, coach or staff member of an academy that uses it.

By using this site or Arenzo you agree to them. If you are under 18, a parent or guardian must hold your Arenzo account and agree to these terms for you.

Three different relationships

Arenzo involves three parties, and it helps to know which one you are dealing with.

RelationshipWho it is betweenWhat governs it
Your training, bookings and paymentsYou and your academyThe academy’s own terms and policies
Your use of the Arenzo app and websiteYou and WatzauraThese terms
The academy’s subscription to ArenzoThe academy and WatzauraA separate customer agreement, which is not public

Your academy, not Watzaura, sets its programs, prices, refunds, cancellations and coaching. When you pay through Arenzo, you are paying the academy. Questions about a booking, a charge or a refund go to your academy first.

Early access and demos

Requesting early access or booking a demo is a request, not a contract. We will reply, and we may ask further questions, but we are not obliged to offer Arenzo to any particular academy, and no pricing, timing or feature commitment is made until a customer agreement is signed. Anything on this site describing Arenzo describes the product as it stands on the date it was published and may change. Prices shown on this site are a guide and exclude GST unless stated.

Using this site

You may read and share the content of this site for the purpose of learning about Watzaura and Arenzo. You may not scrape, copy or republish it commercially, attempt to gain unauthorised access to the site or its services, submit false or abusive information through its forms, or use the site in a way that breaks the law.

Using Arenzo

Your account

Your academy invites you to Arenzo, or you sign up through your academy’s page. Keep your sign-in details to yourself and tell your academy if you think someone else has used your account. You are responsible for what happens in your account, including bookings you make for your children.

If you are a coach or staff member, your academy decides what you can see and do. Use that access only for your work for the academy.

What you may not do

You must not:

  • use Arenzo to harass anyone, or to post anything unlawful, offensive or that you do not have the right to share;
  • upload photos or videos of other people’s children without the consent your academy requires;
  • try to reach records you are not entitled to see, or to get around Arenzo‘s security;
  • copy, scrape, reverse engineer or resell Arenzo; or
  • use Arenzo in a way that breaks the law.

We or your academy may suspend an account that breaks these rules.

The app

We give you a personal, non-transferable licence to use the Arenzo app on devices you own or control, for as long as your academy uses Arenzo and your account is open. If you downloaded the app from the Apple App Store or Google Play, that store’s terms also apply, and Apple or Google is not responsible for the app or for supporting it.

Availability and changes

We work to keep Arenzo available and secure, but it may sometimes be unavailable for maintenance or for reasons outside our control. We improve Arenzo over time, which may change how it looks or works. If your academy stops using Arenzo, your access through that academy ends; your academy will tell you how your records are handled.

Your information

How we handle personal information, including your children’s, is set out in our privacy policy. You can delete your account at any time; see account deletion.

Intellectual property

Watzaura, Arenzo, and the text, design and code of this site and of Arenzo are owned by Watzaura Infotech Pty Limited or used with permission. Each academy’s name, logo and content belong to that academy. Elite Cricket Academy’s name and marks belong to Elite Cricket Academy. Other product names mentioned on this site — such as Momence and Upper Hand — belong to their owners and are used only to identify those products; nothing here implies any endorsement by or affiliation with them.

You keep ownership of anything you add to Arenzo, such as photos or diary entries. You allow us and your academy to store and show it to the people entitled to see it, for as long as it is in Arenzo.

Accuracy and liability

We try to keep this site and Arenzo accurate, and we have a stated policy of not publishing invented customers, metrics, testimonials or launch dates. Content on this site is provided for information and is not advice.

Nothing in these terms excludes, restricts or modifies any right or remedy you have under the Australian Consumer Law, or any other law, that cannot be excluded. Subject to that, and to the extent the law allows, we are not liable for indirect or consequential loss arising from your use of this site or Arenzo, and our total liability to you is limited to resupplying the service or paying the cost of having it resupplied.

Changes to these terms

We may update these terms. We will post the new version here with its effective date and, if a change materially affects Arenzo users, tell you in the app before it takes effect.

Governing law

These terms are governed by the laws of Victoria, Australia, and you agree to the non-exclusive jurisdiction of its courts.
